Terms of Use

1. Acceptance

These Terms of Use govern access to and use of the website raf.dev.br, including its API, chat and games (the "Site"). By accessing or using the Site, with or without an account, you agree to these Terms and to the Privacy Policy. If you do not agree, do not use the Site.

2. Who operates the Site

The Site is operated by Rafael Pontes, an individual resident in Brazil ("we", "us"). "Administrators" means the operator and the people he authorizes to moderate the Site.

The Site is a personal hobby and portfolio project, provided "as is" and "as available".

The Site may display advertising, including from third parties, and offer products, virtual items or paid features. In that case, the conditions of each purchase (such as price, payment method and refunds) will be presented before the purchase, and these Terms and the Privacy Policy will be updated when necessary.

3. Changes to and interruption of the service

We may, at any time and without notice, change, suspend, reset or discontinue any feature, in whole or in part — including game worlds, balance, items, rankings and data. For example, game progress may be reset. There is no guarantee that the Site or any feature will continue to be available.

4. Accounts

• Provide accurate information and keep it up to date.
• Each account belongs to a single person and may not be shared, sold or transferred.
• Keep your credentials secret. You are responsible for all activity on your account and must notify us immediately of any unauthorized use.
• To create an account with a username and password, you need to confirm your e-mail with the code or link we send to it. If you forget your password, you can reset it through the same e-mail.
• Google sign-in is also subject to Google's terms and privacy policy. When you create an account with Google, your Google photo is used as your profile photo on the Site; you can change or remove it at any time.
• Minimum age: 13. Teenagers aged 13 to 17 need the authorization of a parent or legal guardian, who is also responsible for their use.

5. Prohibited conduct

The following, among other conduct, is prohibited (non-exhaustive list):

• hacking or attempting to gain unauthorized access to accounts, systems, servers or data;
• probing, scanning or testing the Site for vulnerabilities without prior written authorization;
• exploiting bugs or flaws — report them through the contact channel instead;
• reverse engineering, decompiling, modifying or tampering with the client, network traffic or communication with the server, beyond what the law expressly allows;
• cheating, including through bots, automation, macros or third-party programs;
• automated data collection (scraping), except indexing by search engines that respect robots.txt;
• denial-of-service (DoS) attacks, flooding or spam;
• circumventing bans, rate limits or security mechanisms;
• impersonating anyone, including administrators;
• harassing, threatening, discriminating against others or inciting hatred or violence;
• posting illegal, sexual, violent or defamatory content, or content that infringes third-party rights;
• disclosing other people's personal data;
• using multiple accounts to gain an advantage, manipulate rankings or evade sanctions;
• trading the Site's items, currency, characters or accounts for real money or other goods outside the Site;
• any other malicious, fraudulent or unlawful use, or use that harms the Site or other users.

6. Moderation and enforcement

Administrators may, at their sole discretion and without prior notice, warn, mute, remove content, suspend or permanently ban users — including by account, IP address or other technical identifiers — and delete characters, game progress or entire accounts, especially in case of suspicious, malicious or abusive use or violation of these Terms.

We are not obliged to explain these measures beyond what the law requires, and they give no right to damages or compensation. Attempting to evade a sanction, for example by creating another account, is in itself a violation of these Terms.

We may preserve records and provide them to the competent authorities when there is evidence of unlawful activity or a legal order.

7. Virtual items and progress

Items, virtual currency (such as gold), characters, levels, scores and any other game progress have no real-world monetary value, cannot be exchanged for money and are not the user's property. We grant only a limited, personal, non-transferable and revocable license to use them within the Site.

Trades between players are at the risk of those involved. We may modify, rebalance or remove any of these elements at any time, without compensation.

8. User content

You keep ownership of the content you post (messages, nicknames, avatar, etc.) and are solely responsible for it, and you declare that you have the rights needed to post it.

You grant us a non-exclusive, royalty-free, worldwide license, for as long as necessary, to host, store, reproduce and display that content for the purpose of operating the Site — including keeping messages in anonymized form after account deletion, as described in the Privacy Policy. Administrators may remove any content at any time.

9. Intellectual property

The Site, its source code, design, texts, art, sounds and other elements belong to or are licensed to Rafael Pontes, except third-party open-source components, which are governed by their own licenses. Copying, modifying, distributing or commercially exploiting these elements without prior written authorization is prohibited, except within the limits allowed by law.

10. Disclaimer of warranties

To the maximum extent permitted by applicable law, the Site is provided "as is" and "as available", without warranties of any kind, express or implied — including uninterrupted availability, freedom from errors, security, fitness for a particular purpose or preservation of data.

11. Limitation of liability

To the maximum extent permitted by applicable law, we are not liable for:

• loss or corruption of data, content or game progress;
• unavailability, interruptions, delays or failures of the Site;
• third-party services (such as Google, hosting providers and push services);
• the conduct or content of other users;
• indirect damages or lost profits arising from the use of, or inability to use, the Site.

Nothing in these Terms excludes or limits rights that cannot be waived by law, including those under the Brazilian Consumer Protection Code (Law No. 8,078/1990), where applicable.

12. Indemnification

To the extent permitted by law, you agree to indemnify and hold Rafael Pontes harmless from any claims, losses, damages, costs and expenses (including reasonable attorneys' fees) arising from your misuse of the Site, your violation of these Terms or the law, or the content you post.

13. Termination

You may close your account at any time using "Delete account" on your Profile page. Administrators may suspend or terminate your access as described in "Moderation and enforcement". After termination, data is handled according to the Privacy Policy.

Provisions that by their nature should survive termination — including virtual items, user content, intellectual property, disclaimer of warranties, limitation of liability, indemnification and governing law — remain in effect.

14. Changes to these Terms

We may change these Terms at any time. Each new version is published on this page with its effective date. Users with an account will need to accept the new version to keep using the Site; for everyone else, continued use after publication means agreement. If you do not agree, stop using the Site and, if you have an account, delete it.

15. Governing law and venue

These Terms are governed by the laws of the Federative Republic of Brazil. If you are a consumer under the Brazilian Consumer Protection Code, the courts of your domicile have jurisdiction. Otherwise, the courts of the judicial district of Rafael Pontes's domicile are chosen.

16. General provisions

If any provision of these Terms is held invalid or unenforceable, the remaining provisions stay in effect. Tolerating any breach does not mean waiving any right. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the use of the Site.
